All India Students’ Association (AISA) president Neha Bora said neither she nor the student organisation would sign the peace bond sought by Delhi Police, adding that they would challenge the notice further after the Delhi High Court declined to entertain her plea against it.

Neha Bora said the proceedings before the Special Executive Magistrate (SEM) must follow the principles of natural justice. She also said she would appear before the SEM court, which has been directed to provide her with the material being relied upon in the proceedings.

“The peace bond which is there today will not be signed by the AISA, or by me," Neha Bora said, adding, “The enquiry will have to move through the principles of natural justice."

Neha Bora said the High Court had not examined the merits of the case at this stage and that the matter could be taken up further. She pointed to the court’s direction asking the SEM to provide her with the material against her.

“The HC has asked the SEM court to show us the material which they have against us," she said, referring to page 34 of the order, which she said required the SEM court to provide the relevant documents.

Neha Bora added that she would appear before the SEM court and contest the proceedings.

The Delhi High Court on Friday rejected her petition challenging the police notice. Justice Subramonium Prasad said, “I am rejecting the writ petition at this juncture." The court also directed the SEM to provide Neha Bora with the material relied upon in the proceedings.

‘How Is A Peaceful Protest A Breach Of Peace?’

Neha Bora questioned the basis for the notice, arguing that the protest on October 16 was not undemocratic. She claimed that any violence during the demonstration was a result of Delhi Police’s lathi-charge on protesters, particularly women. She also disputed the police’s account of the planned demonstration, saying the organisers had called for a gathering at Mandi House and not Connaught Place.

“How is a peaceful protest, breach of peace?" she asked, adding that the bond was being used to curb the right to protest and question the government.

Neha Bora was detained preventively on October 16 while on her way to the Cockroach Janta Party’s ‘Lehra Do Tiranga’ march in Connaught Place. She was released on October 17.
